Terms and Conditions for the Transition Assistance Package for NGV Dual-fuel Vehicles (“Package”)

Introduction

This Package will be valid until 30 April 2025 (“Package Period”).
This document sets out the Terms and Conditions for the Transition Assistance Package for NGV Dual-fuel Vehicles eligible for the complementary removal of NGV kit at selected Partner Workshops (the “Service”) provided by PETRONAS NGV Sdn Bhd (“PNGV”) in collaboration with POMEN Autodata Sdn Bhd (“POMEN”) at POMEN’S partner workshops. The Terms and Conditions are personal to you and are not assignable or transferable by you.
By clicking the acknowledgement box or accepting the Service at the Partner Workshops or via phone booking with POMEN’s customer service team, you acknowledge that you have read, understood, and accepted the Terms and Conditions contained herein. You also confirm that you have the authority and capacity to accept and to be bound by the Terms and Conditions contained herein.
PNGV reserves the right to amend, modify, delete, or change any of the terms and conditions herein contained at any time at its absolute discretion without prior notice. Continued use of the Service following any such changes and/or amendments shall constitute your unconditional acknowledgment, understanding, agreement and acceptance of such changes in respect of the terms and conditions.
In the event of any inconsistencies between the English version and the Bahasa Melayu version of these terms and conditions, the English version shall prevail.

Service Description

The Service is intended to comply with the requirements of the Road Transport Department (“JPJ”) for the deregistration of NGV vehicles.
To be eligible for the Service, the vehicle

(i) must be a dual-fuel vehicle (NGV/petrol/diesel) that is modified with an NGV kit installed and is active; and
(ii) has a Motor Vehicle License (Road Tax) registered with JPJ at any time between 1 October 2021 and 30 September 2024

The Service involves the removal of the NGV Kits Systems as described below, from your vehicle by POMEN’s qualified technicians:

1. NGV Kits System “Sequential Injection”

a. Gas Changeover Switch
b. Pressure Regulator
c. Electronic Control Unit
d. Gas Filter
e. Injection Rail
f. CNG Refueling Valve
g. Pressure Gauge
h. NGV Cylinder
i. Signal Wiring

2. NGV Kits System “Mixer”

a. Gas Changeover Switch
b. Pressure Regulator
c. Spark Timing Advance Processor
d. Mixer c/w hose and power valve
e. CNG Refueling Valve
f. Pressure Gauge
g. NGV Cylinder
h. Signal Wiring
i. Gas Tubing

The Service does not include the repair or replacement of any parts or components that may be damaged or affected by the removal of the NGV Kits System.
After completion of the Service, a three (3) month warranty will be provided to you (“Warranty”) which shall cover the following:

a. Engine tuning (for carburetor engine)
b. Leaking at intake manifold NGV plug screw
c. Engine tuning & diagnostics (for Electronic fuel injections)
d. Wiring works related to NGV system wires which use current/signal supply from the vehicle’s original wire harness.

The Warranty does not cover the following:

a. Spark plugs, Spark plug cables, Distributor, Ignition Coils
b. Oxygen sensor (for Electronic Fuel Injection)
c. Fueling systems (Hose, rails, injector, carburetor, fuel filter, fuel pump)
d. Coolant (if need to replace or bleed the cooling system)
e. Engine Oil
f. ECU (Electronic Control Unit)
g. Transmission control unit
h. Manifold Absolute Pressure (MAP) Sensor
i. Mass Air Flow (MAF) Sensor
j. Water hose (if NGV system equipped with water T-Joint)
k. Throttle Body
l. Battery
m. Alternator
n. Fuse / Relay
o. Any defect or damage existing prior to removal of NGV Kit system
p. Any parts of the car with no direct connection to the NGV Kit system

You shall be required to register for the Service on POMEN’s website via www.peralihanngv.com. Your submitted information will be used to verify your eligibility with the JPJ database of registered NGV vehicles.
You may postpone the Service at any time by contacting POMEN’S customer service within one (1) week from your original appointment date. If you do not attend your appointment, and/or fail to reschedule the appointment within one (1) week, your appointment will be automatically cancelled, and you will be required to apply again for the Service.
For safety reasons and compliance with the Department of Environment Scheduled Waste Regulations, all NGV parts dismantled by POMEN and Partner Workshops shall be disposed for and on your behalf by POMEN and/or Partner Workshops P.U.A_294-2005 (doe.gov.my)

Your Obligations

You shall provide POMEN with full cooperation and such information concerning the NGV vehicle, including but not limited to its use, condition, maintenance records and such other information which POMEN may deem necessary and may reasonably request in order to enable POMEN to perform the Services.
You shall remove all items and articles of value and of importance from your NGV vehicle before handing over the NGV vehicle to POMEN. PNGV and/or POMEN shall not be liable for any loss or misplacement of any such items and articles.
You shall be required to collect your vehicle within 24 hours of the completion of the Service.
If you do not collect your vehicle within 30 days from the time it is ready for collection, or you fail to be contacted, POMEN and/or Partner Workshops may dispose your NGV vehicle without any further notice to you.

Service Warranty, Liability and Indemnification

PNGV warrants that the Service will be performed by POMEN with reasonable care and skill and in accordance with the applicable standards and regulations.
PNGV or POMEN will not be liable for any loss or damage arising from or in connection with the following:
- any defect or malfunction of your vehicle or any of its parts or components that is not caused by the Service;
- any delay or failure in performing the Service due to circumstances beyond POMEN’s reasonable control;
- any loss of use, revenue, profit, or goodwill, or any indirect, consequential, or incidental loss or damage;
- any non-compliance or violation of any laws or regulations by you or any third party in relation to the NGV tank or related NGV kit system components.

Indemnification

You shall defend, indemnify, and hold harmless PNGV and POMEN, its affiliates, subsidiaries and each of its affiliates employee, subsidiaries’ employee, contractors, directors, suppliers, and representatives from:

- all liabilities, losses, claims, and expenses, including reasonable attorneys’ fees, that arise from or relate to your use or misuse of, or access to, the Service; and/or
- your violation of these Terms and Conditions contained herein or any applicable law, contract, policy, regulation and/ or other obligations.

PNGV reserves its right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you will assist and cooperate with us in connection therewith.

Service Refusal/ Termination/Cancellation

PNGV or POMEN reserves the right to refuse, terminate or cancel the Service at any time without prior notice if:

1. you breach any of these Terms and Conditions;
2. POMEN determines that the Service on your vehicle is unsafe, impractical, or unlawful to perform; or
3. POMEN encounters any unforeseen or unavoidable difficulties or obstacles in performing the Service.
